A Perth father, convicted of assault after headbutting another parent who reprimanded
him for swearing at children during a junior football match, is still coaching a junior
team.

JAMES FREDERICK WILKES is on bail with a personal undertaking and will be sentenced
on September 7.

The Perth Magistrates Court found WILKES guilty of headbutting STEVEN O'HALLORAN after
a scuffle during their sons' under 12's football game on May 22 last year.

He continues to be an assistant coach at another team.

The West Australian Football Commission says it's disappointed when unacceptable behaviour
occurs, especially at junior football matches.

ICOm sure I speak for us all when I fondly remember his cameo appearances throughout those years, without whom Saturday nights would never have been the same. I always felt that whilst he supported the surrounding players in a comic role he brought far more to the performance than he was ultimately given credit for.

His ability to chase well endowed women through various staged locations whilst being repeatedly patted on the head by Benny Hill will forever remain with me.I only hope that Rob treats him with greater respect given his advancing years. I urge everyone to tune in tomorrow to see this comic genius.

HOBART, April 7 AAP - Hundreds have gathered in central Hobart to protest against proposed
job cuts at the Mercury newspaper.

The newspaper's management is deciding the future of 33 editorial staff, with the prospect
of sub-editing jobs moving to so-called "sub hubs" on the mainland looming large.

Hobart-based federal independent MP Andrew Wilkie addressed the Save the Mercury rally
on Thursday, telling the crowd of about 300 Mercury staff and members of the public that
the newspaper needed local knowledge to function.

"This paper, the Mercury, can only be effective at providing scrutiny if you have people
on the ground who understand the situation, understand the personalities," he said.

"People will come to you with stories confident you will report it accurately and as
it goes through the editorial process, knowing that stories won't lose their importance
or lose their punch."

Mr Wilkie said the Mercury had a proud history of difference from other News Limited newspapers.

"Independence really matters, and I think it is remarkable that the Mercury has remained
an independent newspaper with an independent point of view," he said.

"The Mercury stands proud as the only News Limited paper that took, albeit for a short
period of time, an anti-Iraq war position.

"You were the only one to get it right. You should be proud of that and we should not
entertain reforms which will get rid of it in the future."

But Mercury editor Garry Bailey said all important editorial decisions would continue
to be made in Hobart.

"There'll be absolutely no reduction in the amount of local content," he said.

"The premise that the paper is under threat is absolutely wrong. They'll be written
by journalists living in Tasmania. They'll be edited sitting in this very same office.

"I don't intend to move to Melbourne, I can assure you of that, and nor will any future editor."

Mr Bailey would not confirm how many jobs would be lost but said the number would "certainly
be less than 20".

"None of the decisions have been made about the reductions in staff," he said.

"There have been reports that all sub-editing operations will be moved to Melbourne.

That's just nonsense. It will not be all jobs."

MELBOURNE, Dec 17 AAP - One man has been jailed while another has walked from court
after they had sex with a 14-year-old girl they met via the MySpace internet site.

The Victorian County Court heard Steven Hondros, 19, contacted the victim and her friend
through the internet social networking site MySpace.

Hondros and his friend Ravinder Singh, 31, later picked up the victim and her friend
from a train station before going to Singh's home in suburban Lalor in September last
year.

The girls had been drinking from a bottle of alcohol in Singh's car and after they
arrived at Singh's house, Singh had consensual sex with the 14-year-old girl.

Hondros also had consensual sex with her.

The court heard the victim had told Hondros earlier that day she was under 16.

Her friend told police she and the victim had told the accused they were both 16.

The prosecution conceded the accused men did not deliberately intend to have sex with
an underage girl.

But Judge Meryl Sexton said they were reckless in determining whether the girl was under 16.

She said they engaged in a serious breach of trust and it was their responsibility
to ensure they acted within the law.

Judge Sexton said the law was intended to protect young girls too immature to make
proper choices about sexual activity and deal with the consequences.

For this reason the law protected them from themselves and adults who may take advantage
of them, she said.

Judge Sexton said the victim was now suffering from the emotional impact of having
sex with the accused, despite it being consensual.

She said she had nightmares and her confidence had deteriorated.

"She gets upset, feels guilty, has difficulty sleeping and trouble concentrating at
school," Judge Sexton said.

Singh, who pleaded guilty to two counts of sexual penetration of a child under 16,
was sentenced to two and a half years' jail, to serve a minimum of 10 months.

The judge acknowledged his tragic personal history and that his judgment at the time
of his offending was impaired due to post traumatic stress disorder.

Hondros, of Thomastown, pleaded guilty to one count of sexual penetration of a child under 16.

He received a wholly suspended 15-month jail term after the judge found there were
exceptional circumstances in his case including his youth, admissions, willingness to
give evidence against his co-accused, and the narrow age gap between him and his victim.

The judge noted that in pleading guilty, the pair had foregone a chance of acquittal
based on a defence that they reasonably believed the victim was over 16.

Each of the accused is now a registered sex offender.

A Supreme Court jury's been told water polo champion KELI LANE might have killed and
disposed of her newborn baby at Sydney's Homebush Olympic site.

Prosecutor MARK TEDESCHI QC said the site .. near Auburn Hospital where LANE gave birth
in September 1996 .. was surrounded at the time by vacant and deserted land .. which would
have given her a nearby opportunity for somewhere private to kill TEGAN and dispose of
the body.

Mr TEDESCHI earlier told the jury LANE kept her pregnancy hidden from her boyfriend
.. family and friends and didn't want the responsibility of a child.

The trial is continuing before Justice ANTHONY WHEALY.

A man will appear in a Melbourne court today charged with multiple sex offences involving
teenage girls.

JOHN RAYMOND ZIMMERMAN .. of Screen Street, Frankston .. faced an out-of-sessions court
hearing at Nunawading police station in Melbourne's east last night.

The 24 year old's been charged with 16 counts each of rape and sexual penetration of
a child under 16 .. five counts of stalking .. three of indecent assault .. one count
of threats to kill .. and one count of procuring a child for the purposes of child pornography.

The offences date back 18 months and involve three victims .. two of whom were aged
14 and one who was 13 at the time of the offences.

Police allege ZIMMERMAN contacted the girls through one of two profiles on an internet
social networking website and later co-erced them into having sex with him.

The retail salesman was arrested at his workplace in Collingwood yesterday following
a joint operation between Nunawading and sexual crimes squad detectives.

He'll appear in the Melbourne Magistrates' Court later today.

Opposition MP ANDREW FRASER could be sacked from parliament following a formal complaint
from fellow New South Wales Labor MP JOHN AQUILINA.

In the written complaint to the clerk of parliament .. obtained by The Daily Telegraph
.. Mr AQUILINA asks that Mr FRASER'S actions be considered by the NSW parliamentary privileges
committee .. a body which has the power to remove MPs.

Mr FRASER was forced to resign from the opposition frontbench on Wednesday .. after
an incident involving fellow Nationals MP KATRINA HODGKINSON.

The paper says Mr FRASER pushed his colleague's arm away as she attempted intervene
in a heated exchange with Mr AQUILINA .. after a vote in the lower house late on Tuesday
night.

Mr AQUILINA .. the government's parliamentary leader .. says parliament should consider
the incident with the utmost gravity .. and must be held accountable for his actions and
dealt with accordingly.

The committee will consider the complaint .. and report back to parliament on the first
sitting day next year.

WA: Second man charged over fatal Christmas bashing

PERTH, Dec 29 AAP - A second man has been charged over a bashing on Christmas Day north
of Perth that left one man dead and his daughter's fiance seriously injured.

Sheep farmer William John Rowe, 49, died in hospital on Boxing Day after his family
was allegedly attacked by a group of about 25 people as they played cricket at Sunset
Beach in Geraldton.

Luke Neil, 29, who had become engaged to one of Mr Rowe's two daughters just three
hours earlier, was allegedly slashed in the face with a broken bottle and had his jaw
and collarbone broken.

Police said a 43-year-old man was charged yesterday with common assault on Mr Neil
but clarified that Mr Neil sustained his serious injuries from a later altercation with
another person.

The man was released on bail and is due to appear at Geraldton Magistrates Court on January 3.

Mathew Roy McDonald, 21, of no fixed address, appeared in the court on Thursday charged
with grievous bodily harm.

He was remanded in custody until January 17 while he seeks legal advice.

Police have said the charges could be upgraded to manslaughter or murder pending the
outcome of an autopsy.

McDonald's uncle Lindsay Councillor has again expressed the family's condolences.

"This matter is now in the hands of the police and the courts and we ask that people
please allow this matter to go through the correct procedures," he said in a statement
issued through the Aboriginal Legal Service of WA today.

Qld: Telstra boss says CDMA replacement on track

BRISBANE, Aug 21 AAP - Telstra chief Sol Trujillo says the rollout of the telco's Next
G phone network, to replace CDMA, is on track.

Federal Communications Minister Helen Coonan says she has received hundreds of complaints
on a government helpline set up to assist consumers forced to switch to Next G once it
is fully up and running.

Senator Coonan says Telstra still has just over a month to get the network right.

But Mr Trujillo was confident all was going according to plan.

"The Next G network is operating very well," Mr Trujillo told reporters in Brisbane.

"We have over one million customers now and we are adding about 100,000 customers a
month so I think the customers are saying it's working very well."

Mr Trujillo said he stood by Telstra's commitment made last year when Next G was launched
that when the CDMA network was shut down the Next G network coverage would be equal to
or better than CDMA in all areas.

"If there are issues, we are encouraging people to point them out and we will deal
with them," he said.

The only question was whether the issue would be politicised, he said.

Mr Trujillo was speaking to reporters outside the Medinfo 2007 conference, which he
addressed today.

Qld: Bouncer charged with patron's murder

BRISBANE, April 5 AAP - A hotel bouncer has been charged with murder after a fatal
incident in Brisbane's south on the weekend.

It's alleged Sese Titoa, 22, tried to enter the Meadowbrook Hotel, in Meadowbrook,
about 10pm (AEST) on Saturday, but was refused entry because he did not have correct identification.

Police say Mr Titoa argued with the security guard, prompting the 44-year-old to punch
him on the left side of his head.

It's believed Mr Titoa fell backwards and hit his head on the ground.

He was taken to Princess Alexandra Hospital where was in intensive care until he died
about 10am (AEST) yesterday.

Police today upgraded the bouncer's charges from grievous bodily harm to murder.

He has been refused bail and he will remain in custody until a court date yet to be set.

SA: Man stabbed during altercation

A 31-year-old man's been charged with attempted murder after a stabbing in Adelaide's
northern suburbs.

Police were called to Salisbury North about 9.30 last night .. to break up a fight
between two men.

One of the men was taken to the Royal Adelaide Hospital with stab wounds .. while the
other was treated for superficial injuries before being charged.

He's expected to appear in the Elizabeth Magistrates Court today.

BRISBANE, April 28 AAP - A woman allegedly infatuated with her daughter's school principal
has told a Brisbane court she is not guilty of stalking him because he did not fear her.

Catherine Elizabeth Gunn, 38, has pleaded not guilty to stalking Alan Raymond Brook
between October 31, 2003, and December, 15, 2004.

Gunn's daughter attended Milton State School in Brisbane's inner west where Mr Brooks
was principal.

Brisbane District Court has been told Gunn sent various letters and cards to Mr Brooks
- some simply about her daughter's schooling but others of a romantic or sexually explicit
nature.

Gunn, who is representing herself, told the jury in her closing address today that
under stalking laws, her behaviour was required to give Mr Brooks feelings of apprehension
or fear of violence and this was not the case.

"While he was here (giving evidence), he did not speak of being apprehensive or fearful
and nor did he look that way while sitting a few metres away from me," Gunn argued.

Gunn's overtures were not reciprocated by Mr Brooks and he called the police after
Gunn sent a seven-page letter to his wife at their home.

Judge Kerry O'Brien will send the jury out to consider their verdict on Tuesday.

Fed: Punitive measures on gap payments unnecessary, say doctors

CANBERRA, Dec 31 AAP - Plans to force surgeons to reveal the full cost of operations
in advance are unnecessary and an act of bad faith, doctors say.

The federal government is considering a plan in which doctors would have to tell private
health patients how much their operation will cost or risk not being paid.

Under the plan, currently being considered by Health Minister Tony Abbott, the Private
Health Insurance Ombudsman would have the power to investigate complaints relating to
gap costs - the difference between what a doctor charges and what a health fund pays.

If the ombudsman ruled that private hospitals had not sought the consent of their patient
to the cost of their treatment, they could rule that the patient should not have to pay.

The plan was put forward by private health funds who have long sought tougher measures
for financial disclosure with gap payments, but the Australian Medical Association today
rejected the idea.

"The current situation is that 80 per cent of the gap payments are known at the time
of surgery," AMA president Mukesh Haikerwal said.

"We have worked very closely with the private health industry and in the new year we're
going to be launching some more information for patients and doctors so that everybody's
aware of the cost of the procedures."

He also accused health funds of acting in bad faith by pushing the plan.

"I think it's an unnecessary measure and it's a measure which smacks of bad faith because
we're working very closely with the health insurers," Dr Haikerwal said.

We're working on a voluntary code, so I'm very surprised to see that suggestion come
through in this form.

"To break ranks and talk about compulsion really is not something that is helpful."

Private health insurers said they would prefer a voluntary code for revealing gap payments,
but said it was time the situation was addressed.

"Everyone would rather it was a voluntary situation," Australian Health Insurance Association
chief Michael Armitage said.

"But I don't think it's too much to expect that patients are told what their medical
treatment is going to cost.

"That to me seems like a really reasonable expectation."

Dr Armitage said talks with doctors and the government were ongoing.

A spokeswoman for Mr Abbott said the plan was among a range of measures being considered
by the minister.

Mr Abbott raised the issue in a speech in June, saying patients ought to know in advance
what their out of pocket expenses would be for operations.

He said the failure to inform patients about gap payments was the biggest grievance
against private health insurers.

Agent’s info leads to a $5,200 bill

Dear Fixer: Last December, my husband and I were planning a trip to Mexico for our belated honeymoon. Around Dec. 4, I went into an AT&T retail store in the Loop to inquire about what features I needed to add to our phone plan so we can use our iPhones in Mexico.

The sales agent told me that by adding AT&T's Mexico Plan for an additional $4 a month, we would be able to make calls, text and surf the Internet with no added fees. A few days later I added the Mexico Plan.

My husband, Jose, left for Mexico ahead of me, on Dec. 15. A few days later, Jose forwarded me an AT&T text message saying we had exceeded our data plan of $19.96 per megabyte and they were suspending his service. I immediately contacted AT&T and spoke with a customer service representative who told me the $4 Mexico Plan only covered calls. It did not include texts or Internet usage.

Also, the phone calls were not deducted from our Anytime Minutes or Unlimited Nights and Weekends. They were an additional 59 cents a minute.

At this point, our phone bill was $5,200.

The only way to reduce it was to add an additional $199 international data plan and $10 global messaging plan (which would cover 50 texts). By adding these features, the bill would be brought down to $2,200.

I called AT&T to express my frustration at being misinformed and to contest the international charges. The rep proceeded to give me all the information about iPhone usage in Mexico. Had the in-store agent provided me with this information, my husband would not have used the Internet and would have texted sparingly and only made calls when needed.

I asked about getting a credit and the phone rep told me he couldn't do anything until the bill dropped, which would be around Jan. 15. Around Jan. 16, I called again to dispute the international charges. The woman I spoke with said I could file a claim, but she said it would probably be rejected because there are a lot of people who just don't want to pay their bills.

I have been an iPhone customer since 2009. I have given AT&T thousands of dollars over the years.

They did reduce the bill from $2,200 to $1,665.88. I called again, arguing that I shouldn't have to be liable for any of these international charges because I was misinformed by their store employee. I was told that it was our fault, because we turned on the data roaming when it said that high charges may occur. However, I was told I would be able to use the roaming feature. They said all the information is on the Internet and that I should have double-checked.

I was told to submit another claim. After that, the bill was reduced from $1,665.88 to $1,562.96.

My bill is usually around $225 a month. Their employee's lack of knowledge resulted in me getting a $1,500 phone bill. As a paying customer, I deserved to be provided with the correct information so I would know what charges to expect.

EDS to Close Morrisville, N.C., Call Center.(Knight Ridder/Tribune Business News)

Mar. 25--One call center is re-opening in Raleigh with plans to hire up to 600 full- and part-time workers, even as another call center with 425 employees is set to close in Morrisville.

Xtrasource, which offers large manufacturers product customer service by phone and over the Internet, has hired 90 employees since it opened this month, but hopes to increase its work force by several hundred in the next year as its client list grows.

But Electronic Data Systems said Friday it will close by early June the customer service call center it has operated for six years in Morrisville. The Plano, Texas-based company said the closing is part of a cost-cutting program and that finding enough workers in the Triangle's tight labor market had become too difficult.

"We've got some good people in Raleigh; it's just hard to find enough of them," said Dana Bolden, spokesman for EDS.

Bolden said about 90 full-time and 120 part-time workers will lose their jobs. The company hopes to shift some of the remaining employees to other EDS offices in the Triangle.

Workers will receive a severance package, as well as a bonus nearly equal to an extra paycheck if they stay until the closing of the call center.

One of the Triangle's largest technology employers, EDS has 1,800 workers in the Triangle. Most of those jobs are in the management of computers, networks and other information systems for clients.

The company, which leases a 30,000-square-foot office for its call center in Morrisville's Southport Business Park, began discussing the future of the call center two weeks ago. EDS closed its call center in Charlotte on March 2, throwing 350 people out of work.

Xtrasource is operating from a 21,000-square-foot office on Trust Drive, north of Spring Forest Road, and hopes to expand into another 10,000-square-feet in the same building.

Paul Tyler, vice president of customer service and telecommunications for Xtrasource, said his company had been looking for a location in the Southeast when it bought Customer Access Resources, which had operated a call center in the same North Raleigh location. Customer Access closed its 120-employee office last month before it was acquired by Xtrasource.

Tyler said he is confident that the Triangle's concentration of universities will provide a ready pool of part-time workers.

"We like to be near campuses," he said. "You can have college students who will come in and work 10 to 12 hours in a week to cover your schedule." Tyler acknowledged that the Triangle's labor market is tight, but said that the company was prepared to find and keep workers.

"It's the same all around the country," he said. "We offer incentives to hold onto workers."

Due diligence tips for sellers, part II of II.(Mergers, IPOs, and Venture Finance: Equities)

Fourth, in-depth due diligence is time consuming; begin this formal process only after the general terms of a transaction have been agreed in writing--for example in a non-binding Letter of Intent (LOI). As negotiations draw close to an LOI, sellers should begin compiling information needed in due diligence. A seller should ask the buyer for a formal "due diligence checklist" immediately after executing a LOI.

Fifth, respond promptly to the buyer's due diligence request with a complete and orderly set of documents. Organize and index the information to correspond with the outline of the buyer's checklist. Sellers gain great credibility and give buyers much comfort about the quality of the business when their due diligence responses are organized, detailed, and complete. Conversely, inaccurate, incomplete, and disorganized responses cause a buyer concern because the potential risks related to buying your company cannot readily be identified and assessed. That concern may result in a reduced purchase price, more onerous terms, broader indemnification provisions, greater ongoing liability for the seller, or even a failed transaction.

Sixth, don't hide anything during due diligence, and instruct employees who are involved to be open and helpful. If the buyer requests highly sensitive information that could be injurious to your company if the deal falls through, consider ways that can satisfy the buyer's "need to know" yet protect your company. For example, if the buyer wants to review highly proprietary source code, you may wish to engage a mutually satisfactory third party and jointly agree on their mandate to provide the buyer with info they need. The scope of the due diligence checklist can be negotiated to meet the needs of both parties.

The due diligence process can seem daunting to even the most seasoned veteran of M&A. As with most areas of facilitating a successful transaction , planning and readiness is key.

Blame game not answer for Smit.

South Africa skipper John Smit has conceded his side can only blame themselves after Australia left their Tri Nations tilt on the brink of collapse on Saturday.

The defending champions have endured a torrid time on the road so far this series, losing twice in New Zealand before going down 30-13 in Brisbane, while each of the three Tests have seen at least one Springbok sent to the sin bin.

Jaque Fourie and BJ Botha were the latest Boks players to see yellow in this year's campaign, Fourie the third to spend ten minutes off the field in the first half following locks Bakkies Botha and Danie Roussouw in New Zealand.

Although a dominant Wallabies side didn't take full advantage of being a man up as the All Blacks did, Smit admitted time needs to be spent at the drawing board to ensure his side don't put in a repeat performance when the All Blacks travel to Johannesburg on August 21. "It wasn't an ideal situation [losing Fourie in the third minute]," the World Cup-winning skipper said. "I just couldn't believe it happened again for the third week in a row. It can't keep happening surely. It's hard to play with 14 men at this level.

"You can see the pace of the Tri Nations is fantastic, when you're a man down you have to cover a lot more ground and it doesn't hurt you really after ten minutes, it hurts you in the 40 or 50 that finish the game."

Earlier in the week, coach Peter de Villiers had sensationally suggested that referees were conspiring against his team in the opening two Tri Nations Tests, claiming rugby chiefs wanted next year's World Cup hosts to be successful.

Despite being forced to apologise, his outburst hasn't eased the pressure on his position, the coach saying, "You must ask my boss," when quizzed about whether he was the right man to lead the Boks into the New Zealand showpiece.

The skipper, however, insists the squad take full responsibility for their dismal start, in which they have conceded at least 30 points in all three matches.

"We just have to be honest with ourselves," Smit said. "We've got ourselves to blame for all three weeks - we're not on the money really. "We're very realistic about how poor, how average we've been in most areas in the last three weeks. As apparent as it is to you, it hits us even more so."
